Terms of Service

Effective Date: [Date]

1. Who We Are

Sukkah Service is a sole proprietorship owned and operated by [Owner's Full Legal Name], serving [Service Area]. We operate the website SukkahSolution.com.

In these Terms, "we," "us," and "our" mean Sukkah Service. "You" means the customer.

2. Agreement

By booking a service or using SukkahSolution.com, you agree to these Terms and to our Service Policy. If you do not agree, please do not book.

3. What We Do

Depending on what you order, we may deliver sukkah materials, assemble and install a sukkah, rent you the frame and panels, sell you a kit, and take the sukkah down after the holiday.

Your booking confirmation lists exactly what you ordered. Anything not on it is not included.

4. Booking and Scheduling

Our season is short, so timing works like this:

Bookings are first come, first served. A booking is confirmed when we send you written confirmation and receive your deposit.

We schedule by date, not by a guaranteed hour. We will give you an arrival window and call if we are running significantly off.

We work hard to finish every installation before the holiday starts. We cannot guarantee it if you book late, and we are not responsible for delays caused by weather, supplier shortages, site conditions, or anything else outside our control.

Late bookings may carry a rush fee and may not be possible at all.

5. Payment

A 50% deposit is due at booking. The balance is due when the installation is complete.

Prices are as quoted on your confirmation. Prices listed on the website may change before you book.

Payments are processed by [Stripe / Venmo / Zelle]. We do not store card numbers.

Prices do not include sales tax unless stated.

6. What You Need to Do Before We Arrive

Clear the installation area of furniture, vehicles, debris, and anything overhead that would interfere.

Give us access: gate codes, parking, building entry, whatever we need to get there and get in.

Tell us where anything hidden is buried or runs beneath the surface. Sprinkler lines, gas lines, cable, septic, waterproofing under a deck or roof. We cannot work around what we do not know about.

Confirm the spot you picked actually works, including what is above it.

Be reachable by phone during the installation window.

If we arrive and the site is not ready, we will reschedule and charge a $50 return trip fee.

7. Permission to Build

You are responsible for confirming you are allowed to put a sukkah where you want it. That includes town permits, HOA rules, condo board rules, and landlord permission.

You confirm that you own the property or have the owner's permission. We do not pull permits and we do not verify HOA or building approval. We are not responsible for fines, removal orders, or disputes that come from not having permission.

8. Halachic Compliance

We build sukkahs using standard construction practice and generally accepted dimensions and materials. We are not a rabbinic authority and we do not certify anything as kosher.

Confirming that your sukkah is kosher for your use is up to you and your rabbi. That includes placement, dimensions, walls, s'chach, and anything overhead. Tell us what you need before we build and we will do our best to accommodate it. Ask us to change something after the fact and we will come back, subject to availability and an additional charge.

9. A Sukkah Is a Temporary Structure

You understand and agree that:

A sukkah is not built to survive high wind, heavy rain, or storms. It may lean, shift, leak, or come apart in bad weather, and that is not a defect.

We are not responsible for weather damage to the sukkah, to your property, or to anyone.

Inspect the sukkah before each use and keep an eye on it through the holiday. If something is loose or has shifted, stop using it and call us.

Supervise children and guests. Watch out for heaters, candles, lights, cords, and cooking equipment. Open flame and portable heaters inside a sukkah are a fire risk, and using them is at your own risk.

Do not climb on the frame, hang from it, attach heavy decorations, or modify it in a way that affects how it stands.

If you want us to come back and re-secure or repair the sukkah during the holiday, that is a separate service call at our current rate.

10. Rented Materials

If you rented the frame, panels, or s'chach:

They stay our property the entire time.

You are responsible for them from delivery until we pick them up, including loss, theft, and damage beyond normal wear.

Do not cut, drill, paint, or permanently alter them.

Missing or damaged pieces are billed at replacement cost.

Please take your own decorations, lights, and belongings out before takedown. We are not responsible for personal items left in or attached to the sukkah.

11. Property Damage

We are careful. That said, installing a sukkah means anchoring, weighting, and putting loads on decks, patios, and lawns, and some marking is normal: flattened grass, minor scuffs, anchor holes.

We are not responsible for:

Damage to anything hidden that you did not tell us about

Pre-existing conditions, like rotted wood, loose pavers, or an unstable surface

Weather damage, or damage caused by you, your guests, or changes you made after we left

Normal cosmetic marks from installation

If you think we damaged something, tell us in writing within 7 days of the work so we can come look at it.

12. Limitation of Liability

To the fullest extent New Jersey law allows, our total liability for any claim connected to your booking is limited to what you actually paid us for that booking. We are not liable for indirect, incidental, or consequential damages.

Nothing here limits liability for gross negligence or willful misconduct.

13. Assumption of Risk and Indemnification

Using a temporary outdoor structure carries inherent risk. You accept that risk for yourself, your family, and your guests.

You agree to hold Sukkah Service and [Owner's Full Legal Name] harmless from claims, damages, and reasonable costs arising from your use of the sukkah, injuries to you or your guests, your failure to get required permission to build, changes you made to the structure, or your breach of these Terms.

14. Photos

We may photograph finished installations for our website and social media. We will not show your address or anyone's face without permission. If you would rather we not photograph your sukkah, just tell us before install day.

15. Calls and Texts

By giving us your phone number, you agree we can call and text you about scheduling, arrival windows, and takedown. Message and data rates may apply. Reply STOP to opt out, though it will make coordinating your installation harder.

16. Website

The content on SukkahSolution.com belongs to us and may not be copied or used commercially without permission. Do not misuse the site or submit false booking information.

17. Governing Law

These Terms are governed by New Jersey law. Any dispute goes to the state or federal courts in [County], New Jersey, and both of us agree to that.

Before filing anything, we both agree to try to work it out in good faith for 30 days after written notice.

18. Changes

We may update these Terms. The version posted when you book is the one that applies to your booking.

If any part of these Terms turns out to be unenforceable, the rest still stands. These Terms and your booking confirmation are the whole agreement between us.
